A new legislative amendment relevant to the functioning of the activities with an impact on the environment is the Emergency Ordinance no.75 / 19.07.2018 for the modification and completion of certain normative acts in the field of environmental protection and of the regime of foreign citizens.

The first major change relates to the validity of authorizations or integrated environmental permits. Initially, the environmental permit had a shelf life of 5 years and the 10-year integrated environmental permit. Under the new legislative changes, the environmental permit and the integrated environmental permit remain valid for the entire period when their beneficiaries receive the annual visa.

Thus, if you own an environmental permit or an integrated environmental permit, it is no longer required to re-authorize and obtain a new permit, but it is still necessary to annually renew the existing permit.

The procedure for the application of the annual visa shall be established by order of the head of the central public authority for environmental protection, within 120 days from the date of entry into force of this emergency ordinance.

The procedure will probably involve the development of documentation to demonstrate that no substantive changes have occurred to the already authorized activity, the payment of a tariff to the issuing authority and its verification by the site.
